These Terms & Conditions ("Terms") govern your access to and use of the RakshYaan mobile application, website at rakshyaan.com, and related services (the "Services") provided by Octavesecure Pvt. Ltd. ("we", "us", or "our").
By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and capable of entering a binding contract under applicable law to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business.
2. The Services
RakshYaan provides privacy-oriented tools for vehicle and asset owners, including QR-based contact flows, optional emergency information you choose to display, document vault features, notifications, and related e-commerce for physical products. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You agree to provide accurate information and to notify us promptly of unauthorised use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
You may request deletion of your account as described in our Privacy Policy and in the app (for example via "Request account deletion"). Some information may be retained where the law requires.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose;
- Harass, threaten, or impersonate others, or misuse contact features to spam or abuse recipients;
- Attempt to gain unauthorised access to our systems, other users' data, or to interfere with the Services;
- Reverse engineer, scrape, or automate access in a way that overloads or circumvents intended use, except as permitted by law;
- Upload malware or content that infringes intellectual property or privacy rights of others.
5. Content you provide
You retain ownership of content you submit. You grant us a worldwide, non-exclusive licence to host, process, display, and transmit your content as needed to operate the Services and as you configure (for example information shown to someone who scans your tag). You represent that you have the rights to grant this licence.
6. Shop, orders, and payments
Product listings, prices, shipping, returns, and taxes are described at checkout and in applicable policies on the website or app. Payments may be processed by third-party providers; their terms may also apply. Risk of loss for physical goods passes as stated in our shipping terms. We reserve the right to refuse or cancel orders in case of errors, fraud, or stock issues.
7. Intellectual property
The Services, including branding, logos, software, and content we provide (other than your content), are owned by Octavesecure Pvt. Ltd. or its licensors and are protected by intellectual property laws. No licence is granted except as expressly stated in these Terms.
8. Third-party services
The Services may integrate third-party services (for example maps, payments, or messaging). Your use of those services may be subject to the third party's terms. We are not responsible for third-party services.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
RakshYaan is a communication and information tool. It does not replace emergency services. For emergencies, contact local emergency services. We do not warrant that any particular outcome (for example that a scan will always reach you) will occur.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Octavesecure Pvt. Ltd. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) INR 2,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
11. Indemnity
You will defend, indemnify, and hold harmless Octavesecure Pvt. Ltd. and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
12. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory consumer protections, courts in India shall have exclusive jurisdiction over disputes arising from these Terms or the Services.
13. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
